Although many people confuse ratification with rectification, these two words have different meanings. The noun ratification comes from the verb ratify. Ratify means to approve and give formal sanction to something; thus, ratification refers to the action of giving formal approval to something, making it valid. This noun is typically used with regard to concepts such astreaties,合同, or agreements.
批准也是一个特定的法律术语。柯林斯词典将批准称为“对先前和未经授权的行为的肯定;批准的作用是将该行为与最初被授权一样。”它以其代理人签订的未经授权合同的委托人的批准(确认或正式批准)的示例。假设一个人代表另一个人准备法律文件(EX:合同),但尚未获得代表该人(校长)的人的批准。当校长正式确认该文件时,该确认可以称为批准。
As mentioned above, ratification is mostly used in contract law and international treaties. The term can also apply to theamendmentsto the宪法of a country and ratification of them.
什么是纠正?
从一般意义上讲,纠正术语是指正确的行动。换句话说,这是指更正或改进。该名词来自动词纠正。但是,纠正术语在法律上具有特定的含义。
In English Law, rectification is the “the power in the courts to correct a document that has been drawn in such a way that it incorrectly reflects the intention of the parties” (Collins Dictionary of Law). In other words, this is a remedy where a court can order to make a change in a document in order to correct a mistake, i.e., what it ought to have said in the first place. In the United States, rectification is also known asreformation。纠正是一种公平的补救措施;因此,其应用是有限的。
